Terms of Services – Gift Card Club Members

YKARDS TERMS OF MEMBERSHIP AND YKARDS MEMBERSHIP AGREEMENT

Please read these terms of service (“terms”, “terms of service”) carefully before using our Service (as defined below) operated by APH Services LLC, doing business as YKards, address: 16192 Coastal Highway, Lewes, Delaware, 19958 County of Sussex, (the “Company”, “us”, “we”, “our”). The use of our Service is subject to the terms of this agreement at all times, together with the additional terms and information contained in:

  • Our Privacy Policy, which sets the terms on which we process any personal data we collect from you, or that you provide to us. By using our Service, you consent to such processing and you warrant that all data provided by you is accurate.
  • Our Acceptable Use Policy, which sets out the permitted use and prohibited uses of our Service. When using our Service, you must comply with this Acceptable Use Policy.
  • Our Cookie Policy, which sets out information about the cookies on our site.

Together, these documents form your agreement (the “Agreement”) with us. By using our Service, you confirm that you agree with and accept these terms of service. If you do not agree to these terms, you must not use our Service.

1. Introduction

Welcome to YKards, a digital membership service that offers a unique combination of benefits to enhance your shopping experience. By subscribing to YKards, you agree to comply with these Terms and Conditions. These terms apply to all YKards members, including but not limited to those who purchase our Digital MasterCard with cashback offers.

By using this service, you confirm that you have read, understood, and agree to be bound by these Terms. We recommend that you review these Terms periodically as we may modify or update them at any time. Continued use of the service following any such modifications constitutes acceptance of the revised Terms.

2. Membership and Benefits

2.1 Membership Offer 

Upon joining YKards, members receive a Digital MasterCard, valid at over 130 merchants in the UK. Members benefit from 4% cashback on all purchases made within this network. The membership costs £69 per month.

2.2 Cashback Program  

Members will receive 4% cashback on purchases made with their YKards Digital MasterCard at participating merchants. Cashback is calculated on the net purchase price after any applicable discounts or returns. The cashback percentage for each merchant is displayed in the YKards membership portal.

2.3 Eligibility for Cashback 

Cashback eligibility is contingent upon the proper use of the YKards Digital MasterCard. The cashback is credited to your account within 30 days of the eligible purchase. Merchants may have specific exclusions or limitations for cashback on certain products or services, which will be indicated at the time of the transaction.

2.4 Welcome Offer Claim Process 

New members are entitled to a £15 welcome discount, which will be applied to their first month’s membership fee, reducing the initial charge from £69 to £54.
Important:
This offer is not automatically applied. To claim the welcome discount, members must contact YKards customer service via email or phone within 14 days of signing up. Failure to claim the offer within this period will result in the full £69 charge for the first month.

Upon verification, the £15 discount will be credited to the first month’s membership fee. Please allow 5-7 business days for the discount to be applied after making the request.

The automatic membership reload will be charged on a monthly basis (unless stated otherwise during the enrollment process). The automatic membership reload is charged automatically, as authorized by the shopper, on the payment method used during the enrollment process, unless the agreement is canceled or terminated by the Company. We reserve the right to increase or decrease the automatic membership reload for each renewal term effective at renewal of your Membership and will give you a 30 days advance notice before doing so.

Please note, the first month’s automatic membership reload includes the possibility of a partial refund as part of the welcome Discount, provided the member is part of that specific promotion. This refund is processed immediately after the redemption form for the welcome discount is approved, effectively serving as a discount on the initial automatic membership reload.

The automatic membership reload can also be refunded to you through the membership deposit on the gift card scheme. However, if the membership deposit is redeemed, no refund is available for that month.

3. Subscription and Automatic Renewal

3.1 Payment and Billing 

The membership fee of £69 per month is charged automatically to the payment method provided at sign-up. By providing payment details, you authorize YKards to charge the membership fee on a recurring basis. This charge will occur on the same date each month, beginning after any applicable free trial period.

3.2 Free Trial and Cancellation 

If a free trial is offered, it will begin on the date of sign-up and will last for the duration specified (e.g., 3 days). You may cancel the subscription at any time during the trial period without charge. After the trial, the £69 monthly fee will be automatically charged unless you cancel your membership.

3.3 Cancellation of Membership  

You may cancel your membership at any time by contacting YKards via email at [email protected] or by phone at +44 330 822 0969. Upon cancellation, no further charges will be applied, but refunds for previously paid months are not offered unless specified under the refund policy.

4. Refunds and Disputes

4.1 Refund Policy 

Refunds are available only in cases where the service has not been used, and the request is made within 30 days of the billing date. If a member uses the Digital MasterCard to make purchases, the refund will not apply.

4.2 Disputes

If you wish to dispute any charges, please contact our support team within 10 business days of the charge. Disputes beyond this timeframe will not be eligible for a refund or review.

5. Card Usage and Security

5.1 Digital MasterCard Use  

The YKards Digital MasterCard can be used at participating merchants in the UK, both in-store and online. The card must be used following the guidelines of each retailer. Misuse of the card or violation of these Terms may result in the cancellation of your membership.

5.2 Non-Delivery and Errors  

If you experience non-delivery of your Digital MasterCard or technical errors, please contact our support team. YKards is not responsible for delays or failures in the delivery of digital cards due to issues outside our control, such as incorrect email addresses.

5.3 Fraud and Security  

Members are responsible for safeguarding their account and card information. Any fraudulent activity or misuse may result in suspension or termination of the account. YKards reserves the right to take legal action in cases of suspected fraud.

6. Changes to Terms and Service

YKards reserves the right to change these Terms and Conditions at any time. Significant changes will be communicated via email or on our website. Continued use of the service after changes implies acceptance of the new terms.

7. Liability and Disclaimers

YKards is not responsible for any loss, damage, or inconvenience caused by the use of the Digital MasterCard or membership benefits. While we strive to ensure accuracy in our communications, we cannot guarantee that all information will be error-free or up-to-date at all times.

8. Governing Law

These Terms and Conditions are governed by the laws of the United States, and any disputes arising under these terms shall be subject to the jurisdiction of the courts of the United States.
